SWAPPROPERTY TERMS AND CONDITIONS OF USAGE

A Special Note About Those under 18 years of age: are not eligible to use our service and we ask that minors (under the age of 18) do not submit any personal information to us or use the service.

Swapping/Part Exchanging/ Selling Through Swapproperty in the UK

1 You agree to pay if you successfully part exchange/swap/sell using the swapproperty service or exchanging contracts with an applicant introduced by swapproperty you will be liable to pay the completion fee of £500.00 of the final agreed price on completion by your solicitor.

2 You agree to provide swapproperty with a Energy Performance Certificate on commencement of marketing, or order a pack from swapproperty or another source. Your property will not be listed or will be removed from the web site until we have an Energy Performance Certificate. EXCLUDES PROPERTIES ABROAD

3 You agree to provide an accurate description and photographs depicting your property, and allow swapproperty to alter that description if we feel it does not. We are not responsible for content from third parties such as vendor or agent listings

4 You understand that no employee of swapproperty has viewed any of the properties available on this web site (unless where stated) and that the property descriptions have been created by the owner or estate agent. Swapproperty can not be held responsible for any inaccuracies or descriptions including photos that may appear to be misleading, or be liable for any costs incurred relating to travel expenses, or any faulty goods included in a part exchange.

5 You agree that swapproperty, under terms of current Anti Money Laundering Legislation require I.D from you and may carry this out electronically

6 You agree that swapproperty can not guarantee a part exchange or property swap.

Cancellation

You have the right to cancel your listing within 7 working days of LISTING your property by contacting us by e-mail, or in writing.

Termination Of The Agreement,Your Listing

You can terminate the agreement and remove your listing at any time by contacting us by e-mail, or in writing. There will be no refund of your registration fee.

We can terminate your listing without refund if:

1. it does not comply to the Property Misdescriptions Act
2. your account is idle for more than12 months (we write to you to advise you of this giving you 10 days to respond to us in writing or via e-mail)
3. your property description or photographic material includes racial or abusive material or material of a sexual nature
4. we do not receive a Energy Performance Certificate
5. your i.d is not verified

Information you supply to us to create your listing:

Instructing us with other agents

It is your responsibility to contact your existing agent and to take note of their terms and conditions with special regard to sole agency agreements and avoid the possibility of paying increased or two fees

Return of welcome e-mail
Return of welcome e-mail. We send you a welcome e-mail with a link to a copy of your listing. We ask you to confirm that the details represent a fair and accurate description of your property. FAILURE TO DO SO WITHIN 5 DAYS will result in your listing being removed. No refund will be offered.

1 You agree to pay £10.00 non refundable Registration Fee and if successfully part exchanging using the swapproperty service or exchanging contracts with an applicant introduced by swapproperty you will be liable to pay the completion fee of £500.00 on completion by your solicitor and that this registration fee is non refundable.

2 You agree to provide swapproperty with a Home Information Pack (HIP) on commencement of marketing, or order a pack from swapproperty or another source. Your property will not be listed or will be removed from the web site until we have a completed pack. EXCLUDES PROPERTIES ABROAD

3 You agree to provide an accurate description and photographs depicting your property, and allow swapproperty to alter that description if we feel it does not.

4 You understand that no employee of swapproperty has viewed any of the properties available on this web site (unless where stated) and that the property descriptions have been created by the owner or estate agent. Swapproperty can not be held responsible for any inaccuracies or descriptions including photos that may appear to be misleading, or be liable for any costs incurred relating to travel expenses, or any faulty goods included in a part exchange.

Information you supply to us to create your listing:

We treat all information listed on this site forming part of your listing including photographic material by you as non confidential and that you agree as such.
You guarantee to us that you have the legal right to list the property and in doing so it will not violate any law or the rights of any person or business whatsoever.
In entering this agreement you give us the royalty-free rights to use, distribute, display and create derivative works from this material without any restriction or responsibilities to you.

Council Property & Housing Association Listings

By paying our advertised fee you agree to our terms and conditions.
We list your property for 3 months from the payment date. When the 3 months has elapsed we will contact you again to offer an extension to your listing. If we do not receive instructions to do so
within 7 days of that date your property will be automatically removed.

You can withdraw your property at any time by contacting us by e-mail, or telephone. If cancellation takes
place after 7 days you will not be offered a refund.

Our involvement is limited to providing an advertising service only. We do not offer advice or arrange your part exchange in anyway.

You give us permission to include your chosen contact details with your listing. We can not be held responsible for any calls to your telephone numbers,
un-solicited e-mail contact to you originating from the e-mail address you supplied. Please be aware that we do not have any contact with potential
applicants/part exchanges who may contact you directly and it is therefore your responsibility to decide if an applicant is suitable to visit your property.
